The Twelfth Fret Online Auction Terms & Conditions

Welcome to The Twelfth Fret’s Online Auction. By participating in our auctions, you agree to abide by the following terms and conditions, which are designed to ensure a fair, transparent, and enjoyable experience for all buyers. Please read these carefully before placing a bid, as they outline your responsibilities, our policies, and important legal information.

By registering with The Twelfth Fret.com, 12fret.com, shop.12fret.com, or any of its associated domains you acknowledge that you have read, understood and agree to all the terms, conditions, rules and regulations stated below and anywhere else within this website without reserve or modification.

You certify that all the information you have provided to The Twelfth Fret on your registration is complete, genuine, truthful and accurate and you undertake to update and maintain the accuracy of these registration details. If information is deemed to be false, your account will be suspended. Valid photo ID is mandatory for all pickups for first time buyers.

Please ensure your chosen username is appropriate and may not be considered offensive in any way. If we feel your username is unsuitable in any way, your account will be suspended, and you must register under a new username. Usernames are public, so please do not put any sensitive information in there, like your full name, or email address. If you use your email address as your username, we will edit it and remove the email suffix. Setting your username to something that promotes any outside entities is forbidden.

YOUR BID IS YOUR CONTRACT

All auction items are payable in person, upon pickup, or online, in advance via our online payment system /Credit Card. We provide nationwide shipping within Canada, and shipping to the Continental US. If you require shipping, please contact us prior to payment, once you receive your invoice. Buyer is responsible for all shipping costs. If buyer arranges shipping independently, buyer assumes all responsibility for any loss or damages that may occur through shipping.

Items can be paid for via cash, debit, credit or via our listed payment methods. All items purchased on or before the designated closing date, must be paid for by the designated end date. If an item is not paid for and picked up by the designated deadline, your items will be forfeit and your account may face suspension or permanent termination.

If you have won an auction item or items that you no longer wish to buy (buyer’s remorse), we do allow members to cancel their purchase(s) by paying a restocking fee for each item they want cancelled (unless stated otherwise in listing comments). This fee is 20% of the sale price of the item(s) being restocked, plus taxes. This fee must be received, and staff must acknowledge its receipt before any removal and payment deadlines pass. Items may only be cancelled prior to receiving the item.

The item’s description is nothing more than a general opinion of the item and is not intended as an official appraisal of value or functionality based totally on the visual appearance of the item. We will not consider returns on items that are assembled, used or missing the packaging the item(s) were sold with. This does not include or extend to damage caused by or during the shipping process. Our warranty covers repair or replacement of malfunctioning parts, and on the occasion where we are not able to correct the item, a refund or store credit will be given at the sole discretion of our management staff. We take return fraud very seriously and take every measure to protect ourselves. All returns are at the discretion of management and if a return is considered abusive of our policies, or fraudulent, it will be rejected, and buyer may be banned from our auctions. If a buyer commits return fraud (swapping items) the buyer will be permanently banned, and a police report will be filed.

Items may only be returned if they are malfunctioning (not working as intended) or were misrepresented in our description. All returns are at our discretion. Returns only accepted if items are returned in the same condition and completeness they were sold in. Claimed defects must be shown via image or video prior to returning item. Our warranty does not cover physical damage that occurs while in your possession and/or not present in the listing for the item. Attempting an abusive return or fraud return will result in permanent suspension. Fraud returns will result in criminal charges. In the case that we can not repair or replace the item, the item may be returned for a refund. Claims must be approval via email prior to returning the item There are no returns, for any reason, for any item marked AS-IS.

Further stipulations are as follows:

Returns Accepted if below criteria is met:

  1. Electronic or Mechanical item has malfunctioned and/or is not working as intended, through normal use, within a 30-day period. Item has not been misused, or physically damaged, or tampered with, while in your possession, and a repair or replacement is not available.
  2. Item has damage that was not described at time of sale, that would affect use.
  3. Item is missing crucial components that were not described in the listing at time of sale.
  4. Item was not listed as the correct product.

Returns will not be accepted for buyers’ remorse: Item does not fit, you purchased the wrong model, you don’t like it. Request an item preview prior to bidding if you are uncertain, or contact us for more info.

Returns will not be accepted if item is missing any components or packaging it was sold with.

Returns will not be accepted if an item has physical damage that was not present at the time of sale.

Any items/auctions that are subject to additional terms and conditions will be disclosed by The Twelfth Fret in a timely and upfront manner and will be enforced accordingly. 

Additional terms and condition per auction event may be in place that can supersede these general terms and condition outlined here. They will be clearly outlined on auction event pages.

Pricing, Product Information, and Buyer Responsibility

MSRP prices displayed on listings may not be accurate. They are taken from a single readily available source and are subject to fluctuation. This is meant for reference and not as a descriptor of the item and it is the buyers responsibility price check themselves. Returns are not accepted if buyer finds a cheaper price elsewhere. Generic product information included on listings is for general reference and may or may not be indicative of the specific item you will be receiving, or the contents and state of the lot. We are not responsible for inaccuracies included in the generic product information, as it is copied and pasted from an external source, for general reference. Refer to our description and pictures for an accurate depiction.

User Responsibility and Misuse Policy

Malicious, false and non-paying buyers / bidders (anyone who bids or are high bidder on items but have no intention of completing the transaction) will have their privileges revoked and account permanently banned, and mischief charges may be filed with law enforcement. You must be at least 18 years old to register or use any service provided by The Twelfth Fret. If you use this site, you are responsible for maintaining the confidentiality of your account and password and restricting access to your computer and you agree to accept responsibility for all activities that occur under your account and password.

Intellectual Property and Copyright Notice

All original content included on this site such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software are the property of The Twelfth Fret or its contents suppliers and protected by international copyright laws. The compilation of all content on this site is the exclusive property of The Twelfth Fret.ca with copyright authorship for this collection by The Twelfth Fret.ca and protected by international copyright laws.

Tax Compliance and Buyer Due Diligence

All items sold by The Twelfth Fret are subject to tax legislation pursuant to tax laws of Ontario and other Canadian provinces. All taxable items that are shipped to the customer will be charged taxes according to their destination as per provincial and federal tax laws.

We try our very best to accurately describe and present each item with a description and clear pictures. It is the bidders / buyer’s obligation to ensure that the item is appropriate and suitable for its’ intended or manufactured use. The Twelfth Fret is an unauthorized re-seller of goods.

Terms of Use and Policy Changes

These terms and conditions which govern your visit to The Twelfth Fret may be changed by us along with the content of this site at any time. If any of these terms and conditions is deemed invalid, void or for any reason unenforceable that term or condition shall be deemed severable and shall not affect the validity or enforceability of any remaining terms and conditions. 

Please note that you have not officially won an item until you have paid for it. Items paid for and not picked up at our physical shop after 30 days of auction close date will be forfeit without refund as to compensate for storage and handling.

The Twelfth Fret reserves the right to cancel, refuse, disqualify, delete or re-list any auction, bid, bidder, buyer or registrant at any time with or without cause. Any user who we deem abusive, or detrimental to the community, or our business will be permanently banned.
